01. Are there any restrictions on foreigners buying property in Turkey?
In general, citizens of most countries can purchase property in Turkey. However, there are some legal restrictions, such as limitations on property size and location (e.g., in military or strategic zones). It is crucial to conduct a legal check through the land registry office to confirm that you are eligible to purchase the specific property you are interested in before making any payment.
02. What is a "Tapu" and why is it so important?
The "Tapu" is the official Turkish title deed, a legal document that proves ownership of a property. It is the single most important document in any real estate transaction. The Tapu contains key information such as the owner's name, the property's location, and its official registered details. All official sales and transfers are recorded on this document by the Land Registry Directorate.
03. Is a preliminary "notarized sales promise agreement" enough to buy a property?
No. While a "sales promise agreement" (Satış Vaadi Sözleşmesi) made at a notary is a legally binding contract that forces the seller to transfer the property in the future, it does not transfer ownership itself. The actual ownership is only transferred through an official procedure at the Land Registry Directorate, resulting in the title deed (Tapu) being registered in your name.
